Continuing Personal Guarantee form
Farmers who appear together on a delivery permit are each liable for all debts and obligations attributable to the delivery permit from CWB delivery contracts and Producer Payment Options (PPOs). The Continuing Personal Guarantee form ensures farmers are aware of this pre-existing responsibility. The Continuing Personal Guarantee relates specifically to delivery contracts and PPOs, and is not related to the cash advance program.
A Continuing Personal Guarantee must be completed by those appearing together on a delivery permit before they are eligible to sign up a Producer Payment Option (PPO) contract.
Continuing Personal Guarantee forms are not required for the following name types:
- Individual
- Corporation
New and existing delivery permits
The guarantee form is included with the Delivery Permit Application for New Actual Producers form. Producers with existing delivery permits can access the form online. Fax the signed form to (204) 983-8031.
Examples of when guarantee forms are required
- The actual producer is a partnership, trade name or joint operation – the actual producer completes a guarantee form.
- The actual producer is an individual and the landlord is a partnership or joint operation – the landlord completes a guarantee form.
- The actual producer and the landlord are both partnerships or joint operations – the actual producer and landlord each complete a guarantee form.
The actual producer is a joint operation that contains a partnership – the actual producer completes a guarantee form, and the included partnership completes a separate guarantee form.
Example of a joint operation containing a partnership
John Smith + XYZ Farms complete two forms:- one form for the joint operation John Smith + XYZ Farms (the form must be signed by John Smith and one member of XYZ Farms with signing authority)
- one form for the partnership XYZ Farms (the form must be signed by all individuals who are part of XYZ Farms)
